Terms of Service

These Terms of Service (the "Terms") are an agreement between you and Mazin Submersible Technology, Inc. (the "Company") governing your access to and use of Darkstar Duel™, DarkStarDuel.com, and related online services (collectively, the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The Company's Privacy Policy explains how information is processed when you use the Service and is incorporated into these Terms.
1. Eligibility
You must be at least 13 years old to use the Service. If you have not reached the age of legal majority where you live, your parent or legal guardian must review and agree to these Terms on your behalf. You may not use the Service if applicable law prohibits you from doing so.
2. Limited player license
Subject to your compliance with these Terms, the Company grants you a limited, personal, revocable, nonexclusive, nontransferable, and nonsublicensable license to access and play the publicly delivered version of the Service for personal, noncommercial entertainment. This license does not transfer ownership and does not grant any right to the Company's source code, development repository, reusable assets, or internal systems.
3. Ownership
The Service and its original code, audiovisual content, writing, designs, and other protectable material are owned by or licensed to the Company. Darkstar Duel™ and associated branding are trademarks of the Company. Third-party components remain the property of their respective owners and are governed by their applicable licenses. All rights not expressly granted in these Terms are reserved.
4. Acceptable use
You may not:
- copy, modify, distribute, sell, lease, sublicense, or commercially exploit the Service or its assets;
- reverse engineer, decompile, or attempt to extract source code, except where applicable law expressly permits it;
- use cheats, automation, modified clients, exploits, or deceptive practices to obtain an unfair advantage;
- interfere with the Service, matchmaking, another player's connection, or security controls;
- impersonate another person or use the Service unlawfully; or
- probe, attack, overload, or gain unauthorized access to any system associated with the Service.
5. Multiplayer connections
Online matches may establish a direct peer-to-peer connection between players after matchmaking or use a third-party TURN relay when a direct route is unavailable. Network addressing information and gameplay traffic may therefore be transmitted directly between the participating devices or carried by the relay provider. You are responsible for the security of your device and network and for your conduct toward other players.
6. Service operation and changes
The Company may update, rebalance, suspend, or discontinue any part of the Service. Matches may be interrupted by software defects, network conditions, maintenance, or third-party infrastructure. The Company does not guarantee that the Service will always be available, compatible with every device, or free of errors.
7. Feedback
If you voluntarily provide suggestions or feedback about the Service, you grant the Company a perpetual, worldwide, irrevocable, royalty-free, transferable, and sublicensable license to use and incorporate that feedback without restriction or compensation. This provision does not transfer ownership of material unrelated to your feedback.
8. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." THE COMPANY DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND QUIET ENJOYMENT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THESE DISCLAIMERS MAY NOT APPLY TO YOU.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROFITS, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATING TO THE SERVICE. THE COMPANY'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNT YOU PAID THE COMPANY FOR THE SERVICE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITS DO NOT APPLY WHERE LIABILITY CANNOT LAWFULLY BE LIMITED.
10. Termination
You may stop using the Service at any time. The Company may suspend or terminate your access if you violate these Terms, create risk or legal exposure, or interfere with the Service or other users. Sections that by their nature should survive termination will survive, including ownership, disclaimers, liability limitations, and governing law.
11. Governing law
California law governs these Terms, without regard to conflict-of-law principles. Except where applicable consumer law requires otherwise, claims relating to these Terms or the Service must be brought in the state or federal courts located in Santa Barbara County, California, and you and the Company consent to their jurisdiction. Nothing in these Terms limits nonwaivable rights available under applicable law.
12. Changes to these Terms
The Company may update these Terms as the Service changes. The revised Terms will identify their effective date and will apply prospectively when posted. If a material change requires additional notice or consent under applicable law, the Company will provide it. Continuing to use the Service after revised Terms take effect constitutes acceptance where permitted by law.
13. General provisions
These Terms are the entire agreement concerning the Service except for any additional terms the Company presents for a specific feature. If a provision is unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver. You may not assign these Terms; the Company may assign them in connection with a merger, acquisition, reorganization, or sale of assets.
